Madonna Faces Legal Action from Fans Disgruntled with Late Night Show Start

Two Madonna fans in New York City are suing the pop star for starting her concert late, claiming that they “had to get up early to go to work” the following morning.
In a lawsuit filed on Wednesday in Brooklyn federal court, Michael Fellows and Jonathan Hadden claim they purchased tickets to Madonna’s Celebration tour show at Barclays Center on December 13th.
According to the lawsuit, the 65-year-old musician did not take the stage until after 10.30 p.m., despite the fact that the show had been advertised to begin at 8.30.
By the time the two concertgoers left after 1am, they were “left stranded in the middle of the night” and “confronted with limited public transportation, limited ride-sharing, and/or increased public and private transportation costs”.
The late finish on the weeknight show also impacted their ability to “take care of their family responsibilities the next day,” according to the lawsuit.
Fellows and Hadden accuse Madonna, Barclays Center, and tour promoter Live Nation of “unconscionable, unfair, and/or deceptive trade practices” for the delayed start time, which they claim is a breach of contract and “a willful exercise in false advertising.”
Class Action Filed for Late Shows, Previous Lawsuits Dismissed
The lawsuit seeks class action status for attendees of other Celebration shows that began late, such as Madonna’s next two concerts in New York on December 14 and 16.
Delays are not unusual in the live music industry. In 2019 a Florida fan claimed that Madonna’s tardiness on her Madame X tour was a breach of contract, and two New York concertgoers filed a similar lawsuit in 2020.
Both suits were later voluntarily dismissed.
